The Varied Australian National University Enterprise Agreement 2005 – 2008Schedule 1 - Conditions of AppointmentS1.1 Senior Management PositionsS1.1.1 “Senior Management employment” means employment in a senior management position excluded from certain conditions contained in this Agreement; on a performance based Employment Agreement. For the purposes of this Agreement, a ‘Senior Management position’ employed on the above agreement means one of the following positions howsoever titled, retitled or restructured from time to time: S1.1.2 Positions equivalent to or more senior than Pro Vice-Chancellor or Dean, which includes: College Conveners, Head of Centre as determined by University Council, Directors of Administrative Divisions or equivalent, and Heads of Halls of Residence, who at the date of entry into the employment agreement with the University receives a salary of not less than $108,006 (general staff) or $125,397 (academic staff). These amounts, effective from date of certification, will be indexed to the general rate of salary increases in this Agreement. S1.1.3 Clauses 15, 17, 18, 20, 21, 42, 43, 46, 47, 50, 51, 54, 55, and S3.6 of this Agreement will not apply to a staff member entering into an employment agreement after 13 October 2000 for employment in a senior management position as defined in S1.1.2. The University and the senior manager will be bound in regard to the matters contained in those clauses by the provisions of the Employment Agreement between them, except where the senior manager has an AWA. Where the Employment Agreement of a senior manager provides the right of reversion to a substantive position within the University, the provisions of clauses 42, 43, 47, 50, 51, 54, and 55 will apply following exercise of that right by the staff member, except where the senior manager has an AWA. S1.2 Types of EmploymentS1.2.1 ‘Standard employment’ means employment that is for an indefinite period and may be full time or part time. S1.2.2 'Part time employment’ means employment of less than the standard hours per week. A part time general staff member will either: S1.2.2 (a) work a regular pattern of hours which totals less than the full time hours in a pay period; S1.2.2 (b) have a regular pattern of employment which, (over a specified period) is equivalent to an agreed number of part time hours in a pay period, for which the staff member will be paid accordingly; or S1.2.2 (c) involves agreed periods of attendance on full pay and periods of stand-down without pay. A staff member employed part time is entitled to the same employment conditions, calculated on a pro rata basis, as an equivalent full time employee, with the exception of flex time for general staff. S1.2.3 ‘Fixed term employment’ means employment on a full time or part time basis for a specified term or ascertainable period, for which the Employment Agreement will specify the starting and finishing dates of that employment (or in lieu of a finishing date, will specify the circumstance(s) or contingency relating to a specific task or project, upon the occurrence of which the term of employment will expire, for example where external funding ceases). A fixed term staff member is entitled to the same employment conditions specified in this Agreement and where applicable as would apply to a staff member with standard employment engaged in an equivalent classification and working an equivalent proportion of normal weekly hours for the classification. S1.2.4 ‘Casual employment’ means employment on an hourly basis which is normally for an irregular pattern of hours on an intermittent or irregular basis. S1.2.5 ‘Research Academic Staff Career Employment’ (RASCE) means academic employment at Levels A, B, or C, predominantly for research: S1.2.5 (a) Employment of academic staff under RASCE will be for an initial period of 7 years, with the option of renewal or conversion at the end of the initial employment agreement if the criteria set out below are met. S1.2.5 (b) During the first year of employment, the academic staff member will be engaged almost entirely on research activities (other than teaching on an occasional basis). For the remaining 6 years, the contact teaching load will not exceed an average of 40% of that which would apply to a comparable standard teaching-and-research position for the same classification, academic area and fraction. S1.2.5 (c) Six months prior to the end of the 7-year period of employment, the University will decide either to: (i) terminate the employment (in which case the staff member will receive a severance payment applicable to fixed term staff); or (ii) convert the employment to a standard Employment Agreement; or (iii) to engage the staff member for a further 7-year appointment under the same terms as the initial employment; (iv) where relevant provide notice of termination for the employment to end at a later date than the end of the initial 7-year period, to complete a research project on which the staff member is currently employed. S1.2.5 (d) In making this decision, the University will have regard to the security of funding of the relevant academic area or activities in relation to the mix of standard, RASCE and fixed term employment, the performance of the staff member, as well as other relevant factors. The University will not unreasonably refuse a request for conversion to standard employment or for a further 7-year period, to which all of the above conditions apply. A staff member will not be engaged on more than two such fixed term periods of employment. S1.2.5 (e) During a RASCE, the termination provisions of this Agreement that apply to standard employment will apply, except for termination on the grounds for redundancy. S1.2.5 (f) Unless otherwise specified including S1.2.5(a) to (e), a staff member on a RASCE will have the same conditions of employment as a staff member with standard employment. S1.2.6 ‘Graduate Recruitment and Development Program’ S1.3 Employment SchemesS1.3.1 The University may employ a staff member on one of the following fixed term employment schemes, which do not attract severance payments: S1.3.2 ‘Replacement Employee Scheme’ is a scheme which allows for employment of a staff member to undertake the work of another staff member absent on leave or secondment, perform the duties of a vacant position where recruitment action has commenced, or perform the duties of a position where the normal occupant is performing higher duties in a vacant position for which recruitment action has commenced. S1.3.3 ‘Professional Practice Scheme’ is a scheme where a curriculum in professional or vocational education requires that work be undertaken by a person to be engaged who has or requires practical or commercial experience. Employment periods on this scheme will not total more than 2 years. S1.3.4 ‘Career Entry Development Schemes’ are available for new employees means employment of staff members who may or may not have completed Year 12, or tertiary studies, and the University considers it appropriate to enter into arrangements concerning their studies while they earn a salary and develop on-the-job skills. S1.3.5 ‘Student Internships Scheme’ is a scheme to provide career development opportunities for university students. Employment will be offered on a general staff fixed term basis within the ANU Officer 3 salary level. S1.3.6 ‘Student Employment Scheme’ is a scheme where a student is employed to perform work generally related to their course, for the period of their course, including any short period thereafter. S1.3.7 ‘An Apprenticeship Scheme’ is a scheme where a person is employed as an apprentice for a time to complete disciplines to obtain recognition in their chosen trade/vocation. S1.3.8 ‘Trainee Technical Officer Scheme’ is a scheme where a staff member is employed for a specified period to complete a prescribed course of study. The traineeship may be extended by agreement between the University and the trainee due to illness or where there is the need for additional time to complete the relevant course/s. S1.3.9 ‘Trainee Scheme’ is a scheme where a staff member is employed for a fixed term to complete an approved training course or training program. A trainee will be employed subject to an agreement made between the University and the trainee and registered with the relevant State or Territory Training Authority. S1.3.10 ‘Pre-Retirement Scheme” is where a staff member declares his or her intention to retire, and enters into an employment agreement with a cessation date on or around their stated retirement date. |
