54. Expiry of a fixed term appointment

54.1 Options at Expiry of Employment Agreement

54.1.1 A staff member whose performance has not been found to be unsatisfactory and who is not employed under one of the employment schemes referred to in S1.3 will, subject to further work being available in the relevant position, be offered that work, provided that the staff member was initially employed after a normal competitive selection process for the relevant type of position.

54.1.2 In addition, a staff member with more than 12 months continuous service may apply for conversion to standard employment not less than 3 months prior to the expiry of the fixed term employment agreement. The University, in considering such an application, will have regard to any relevant matters, including the funding security for the position, the performance of the staff member, and the field attracted in advertising the initial fixed-term employment. The University may refuse to grant the application, but will not unreasonably do so. If the staff member’s employment agreement is not renewed or converted they are entitled to severance payments under clause 55.

54.1.3 The above does not prevent the Director, Human Resources making an employment offer at his or her discretion. In these circumstances, this does not prevent the staff member being considered eligible for conversion or severance payments.

54.2 Severance pay is not payable where:

54.2.1   the staff member is employed under an employment scheme in S1.3;

54.2.2 the staff member declines the further employment;

54.2.3 the staff member obtains further employment within the University without the loss of accrued entitlements; or

54.2.4 the University assists the staff member in securing the same or similar employment with another employer, with transfer of all accrued entitlements.

54.3 Notice of expiry of employment agreement
The University will provide to a staff member employed on a fixed term Employment Agreement, other than under a defined employment scheme, written notice of its intention to renew, or not to renew, employment with the University upon the expiry of the Employment Agreement.   The minimum notice periods are those specified in clause 51.
