12.  Genuine Choice of Agreement

12.1 When offering employment or making an offer to vary the employment relationship, the University will provide staff with relevant information so they may make a genuine and informed choice regarding their Employment Agreement with the University. The person receiving the offer of employment may choose between a letter of offer and an Australian Workplace Agreement (AWA), or a letter of offer with reference to this Agreement. The above does not prevent the University from offering different terms and conditions through an AWA to address particular requirements.

12.2 The Employment Agreement will provide for all the terms and conditions that relate to the staff member’s employment.

12.3 Australian Workplace Agreements
12.3.1  A staff member’s career prospects will not be adversely affected regardless of the form of Employment Agreement they have with the University.

12.3.2  Noting that the University attracts many of its staff from overseas, a staff member’s choice of Employment Agreement will be confirmed within 21 days of commencement.

12.3.3  The University and the staff member have the right to appoint a Bargaining Agent in writing in relation to the making, approval, variation or termination of an AWA.
